These Terms and Conditions ("Terms") govern your use of the services provided by Fotoco ("we," "us," or "our") and your access to our website at fotocobooth.com. By booking our services or using our website, you ("Client" or "you") agree to be bound by these Terms. Please read them carefully before proceeding.
Services
1.1 Scope of Services
Fotoco provides photo booth rental services for private and corporate events, including but not limited to weddings, birthday parties, corporate functions, and other celebrations. The specific services, features, and deliverables included in your booking will be outlined in your booking confirmation.
1.2 Service Availability
Our services are subject to availability. A booking is not confirmed until you have received a written booking confirmation from us and any required deposit has been received. We reserve the right to decline any booking at our sole discretion.
1.3 Setup and Operation
Fotoco requires reasonable access to the event venue prior to the agreed start time to set up equipment. The Client is responsible for ensuring that an appropriate space is available, including access to a standard power outlet within a reasonable distance of the photo booth setup area. Any delays caused by venue access issues or unsuitable conditions may result in a reduced operational time without any refund or adjustment to fees.
Bookings and Payment
2.1 Booking Deposit
A non-refundable deposit is required to secure your booking date. The deposit amount will be communicated to you at the time of booking. Your date will not be held without receipt of this deposit.
2.2 Remaining Balance
The remaining balance of your booking fee is due no later than fourteen (14) days prior to your event date, unless otherwise agreed in writing. Failure to pay the remaining balance by the due date may result in cancellation of your booking.
2.3 Accepted Payment Methods
We accept payment via the methods listed on our website or communicated to you at the time of booking. All fees are stated in U.S. dollars.
2.4 Pricing
All pricing is as quoted at the time of booking. Fotoco reserves the right to update pricing for future bookings at any time. Once a booking is confirmed and a deposit has been paid, the agreed price will be honored.
Cancellations and Rescheduling
3.1 Cancellation by Client
If you wish to cancel your booking, you must notify us in writing as soon as possible. The non-refundable deposit will be forfeited upon cancellation. Cancellations made within thirty (30) days of the event date may be subject to additional cancellation fees up to the full booking amount, depending on the circumstances.
3.2 Rescheduling by Client
We will make reasonable efforts to accommodate rescheduling requests, subject to availability. Rescheduling requests must be made in writing at least thirty (30) days prior to the original event date. Rescheduling is not guaranteed and may be subject to a rescheduling fee.
3.3 Cancellation by Fotoco
In the unlikely event that Fotoco must cancel your booking due to circumstances beyond our control (including but not limited to equipment failure, illness, or force majeure events), we will provide you with as much notice as possible and offer either a full refund of all amounts paid or an alternative booking date. This will be our sole liability in the event of cancellation by us.
Photos, Videos, and Intellectual Property
4.1 Ownership
Fotoco retains ownership of all photographs and videos captured using our equipment at your event. By booking our services, you are granted a non-exclusive, non-transferable license to use the images for personal, non-commercial purposes.
4.2 Marketing Use
Fotoco reserves the right to use photographs and videos taken at your event for marketing and promotional purposes, including on our website and social media channels, unless you have submitted a written opt-out request prior to your event date. To opt out, please contact us at the email address listed at the end of these Terms.
4.3 Client Content
If you provide us with any logos, images, or other materials for use in custom photo templates or overlays, you represent and warrant that you own or have the necessary rights to use such materials and that their use by Fotoco will not infringe upon any third-party rights.
Client Responsibilities
5.1 Venue Permissions
The Client is responsible for obtaining all necessary permissions from the event venue to allow Fotoco to operate a photo booth on the premises. We are not liable for any losses or costs resulting from a venue's refusal to permit our services.
5.2 Guest Conduct
The Client is responsible for the conduct of their event guests. Fotoco reserves the right to cease operations if our staff or equipment is subjected to abusive, threatening, or unsafe behavior. In such circumstances, no refund will be issued.
5.3 Equipment Care
The Client accepts responsibility for any damage to Fotoco equipment caused by guests or other parties at the event. The cost of repair or replacement of damaged equipment will be billed to the Client.
Limitation of Liability
6.1 No Consequential Damages
To the fullest extent permitted by applicable law, Fotoco shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the provision of our services, even if we have been advised of the possibility of such damages.
6.2 Maximum Liability
Our total liability to you for any claim arising out of or related to your booking shall not exceed the total amount paid by you to Fotoco for the services giving rise to the claim.
6.3 Technical Issues
While we take every precaution to ensure our equipment operates correctly, Fotoco is not liable for technical failures, print malfunctions, software errors, or data loss beyond our reasonable control. In the event of equipment failure, we will make every reasonable effort to resolve the issue promptly.
Indemnification
You agree to indemnify, defend, and hold harmless Fotoco and its owners, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your breach of these Terms, or any act or omission of your event guests.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of California.
Changes to These Terms
Fotoco reserves the right to update or modify these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Your continued use of our services following any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
